Terms and conditions


References to PTOLEMUS and PTOLEMUS Consulting Group relate to PTOLEMUS sprl, a Belgian company registered under company number BE 0820.589.316, and any related companies of the PTOLEMUS Consulting Group. “The User” means the company accessing the Location Study. “The Study” refers to the full version of the European Location Study 2010 supplied by PTOLEMUS to the user including all attached materials such as Market Forecasts spreadsheets.

1- Copyright and licensing conditions

The Study is proprietary to PTOLEMUS and the copyright and all other intellectual rights belong to PTOLEMUS.

The User acknowledges that PTOLEMUS is the sole owner of all the intellectual property rights related to the Study. The report is protected by copyright laws including all applicable laws in the country in which it is being used. None of the material, nor its content, nor any copy of it, may be altered in any way, or transmitted to or distributed to any other party or published, without the prior express written permission of PTOLEMUS.

Upon the User’s full payment of the Study, PTOLEMUS grants to the User a limited non-exclusive license, in perpetuity to use the Study’s materials.

The User agrees that it will not disseminate any information contained in the study to any person not currently employed by the User and that the use of the information shall be limited to its employees for use in furthering their business objectives. If the Study is transferred by the User to other companies or third parties, the User agrees that it will pay PTOLEMUS the cost of the Study for each company or third party that has had access to the Study.

If the User wishes to quote a figure, a fact or any other item from the Study in a public statement, its license allows it to do so provided it indicates that the source is PTOLEMUS Consulting Group.

2- Liability of PTOLEMUS
PTOLEMUS made every effort to ensure information presented in the Study is accurate and complete at the time of the publication. The User is however reminded the Study contains estimations and forward-looking statements that could not be verified at that time. PTOLEMUS does not accept liability for any direct, indirect, special, consequential or other losses or damages of whatsoever kind arising out of access to, or the use of the Study or any information contained in it.

3- Liability of the User
The User certifies that it is a company registered for VAT or similar in the country where it is based. All users within the European Union are obliged to provide their VAT registration number upon request. Should the User not provide its VAT registration number when placing an order, PTOLEMUS will reserve the right to charge Belgian VAT afterwards if the User is based in any European Union member state other than Belgium.

4- Payments and delivery
All prices are in Euro (€) and exclusive of VAT if nothing else is stated. Payments are made in advance by the User and the Study will be sent by email to the address provided once PTOLEMUS has received the agreed sum from the User. Credit card payments are normally completed immediately after the purchase is made.

5- Cancellation and returned goods
Orders placed in the online store cannot be cancelled once approved. No refunds can be made for approved credit card purchases. The Study is not returnable once delivered.

6- Governing law
These terms and conditions shall be governed in accordance with the laws of Belgium. The Belgian courts shall have exclusive jurisdiction over any dispute arising out of your use of this website.

In the event that any or any part of the terms contained in these terms and conditions shall be determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term shall to that extent be severed from the remaining terms, which shall continue to be valid and enforceable to the fullest extent permitted by law.
